On May 1, 2020, Regulation 2018/1480 will enter into force, representing the 13th ATP (Adaptation to Technical Progress) of the CLP Regulation. The purpose of this Regulation is to amend or introduce new entries in Annex VI of the CLP Regulation.
13th ATP CLP: WHICH SUBSTANCES ARE INVOLVED
Among the substances affected are:
- Potassium permanganate (CAS 7722-64-7 EC 231-760-3): a new classification is introduced as suspected reprotoxic (Repr. 2 – H361)
- Pyrocatechol (CAS 120-80-9 EC 204-427-5): the classification changes from harmful if swallowed and in contact with skin to toxic (Acute Tox. 3 – H301 & H311); new classifications are also added: carcinogenic (Carc. 1B – H350), qualifying it as a carcinogenic agent, and suspected mutagenic (Muta. 2 – H341)
- Acetaldehyde (CAS 75-07-0 EC 200-836-8): the classification is upgraded from suspected carcinogen to carcinogen (Carc. 1B – H350), thus qualifying it as a carcinogenic agent, and suspected mutagen (Muta. 2 – H341) is added
- Maleic anhydride (CAS 108-31-6 EC 203-571-6): among various changes, the classification as skin sensitiser is updated to category 1A (Skin Sens. 1A H317) with a specific concentration limit (Skin Sens. 1A; H317: C ≥ 0.001%). It is necessary to verify the correct classification and labelling of mixtures containing this substance
- Reaction mass of 5-chloro-2-methyl-2H-isothiazol-3-one and 2-methyl-2H-isothiazol-3-one (3:1) (CAS 55965-84-9): reclassified from sensitiser category 1B to 1A, with the addition of an acute and chronic M-factor of 100. Mixtures containing this substance should be reviewed carefully
- Tetramethrin (CAS 7696-12-0 EC 231-711-6): a newly introduced substance under the BPR review plan, classified as suspected carcinogen (Carc. 2 H351) and given an M-factor (acute and chronic) of 100. Classification of mixtures should be verified
- Salicylic acid (CAS 69-72-7 EC 200-712-3): newly introduced substance, classified as suspected reprotoxic (Repr. 1B – H361)
- 2-methylisothiazol-3(2H)-one (MIT) (CAS 2682-20-4 EC 220-239-6): also newly introduced, harmonised classification as skin sensitiser category 1A (Skin Sens. 1A – H317) with a specific classification limit (Skin Sens. 1A; H317: C ≥ 0.0015%). Ensure correct classification of mixtures containing this substance

If not already done, it is important to check whether any of the substances listed in the 13th ATP are present in your products, in order to determine the need to update Safety Data Sheets and product labels accordingly.
