On January 6, 2022, was published in the Official Gazette of the European Union the Delegated Regulation (EU) 2022/1 of the Commission, amending the Regulation (EU) 2021/821 on the control of exports, brokering, technical assistance, transit and transfer of dual-use products.
Dual-use products include both tangible and intangible goods, such as software, designs and technologies, which, although created and sold for civilian use, may also be used for military purposes. Therefore, the export of the goods listed in the dual use regulation is subject to various provisions and controls concerning export activities to other countries.
The new Regulation mainly makes editorial amendments, without bringing any substantial changes to the provisions already in force, correcting several inaccuracies and cross-references in Annex I of the previous version.
We would also like to point out that during the last Export Control Forum, held in Bruxelles on 8 December 2021, it was announced that a new update of the list of dual products will be published in 2022 (probably in the last quarter), which will introduce more impactful changes.
