Nitrogen generated from ambient air has been included among the biocidal active ingredients of Annex I of Regulation (EU) No. 528/2012, as reported in the Official Journal of the European Union (L series of 6 May 2024) with Delegated Regulation 2024/1290.
The Commission considered possible to include this substance among the active ingredients of Annex I provided that the conditions imposed by ECHA are respected: the applications for authorisation of the product must contain evidence that the user and the public are not exposed to hypoxic atmosphere and, where appropriate, that the necessary measures are taken.
