We would like to point out that the Turkish Ministry of Environment, Urbanization and Climate Change (MoEUCC) released, on February 3, 2023, the updated guidance on the registration requirements under the KKDIK regulation, introducing relevant changes. In particular:
- the importer information that has to be disclosed in the dossier for the registration of a chemical substance are now optional rather than mandatory, facilitating the process for non-Turkish companies that are working with an OR. Still, the Only Representative will have to keep an up-to-date register of all the Turkish importers and the tonnage band covered for each one of them, as well as the information on the latest revision of the SDS;
- the Chemical Safety Report (CSR) doesn’t have to be strictly in Turkish but it may be submitted in English as a first step. This provision aims to speed up the registration process as the deadline (December 31, 2023) is rapidly approaching. A transitional period of one year after the registration deadline will be granted for the implementation of the translated CSR in Turkish, that is therefore still required;
- also, the “Registrant Identity” and the “Registration Number” may now be marked as confidential business information (CBI) in the registration dossier. The CBI claims are therefore subject to fees.
