Case C-144/21, in which the Court partially annulled Commission Decision C(2020)8797 – the CTACSub authorisation – for uses 2, 4, and 5 and for use 1 (preparation of formulations for the aforementioned uses), requires the Commission to issue a new decision on this authorisation by 20/04/2024.
– If the Commission issues a negative decision by 20/04/2024, companies will be required to cease using Chromium(VI) as of the date of publication.
– If no decision is issued:
- all downstream users will again benefit from the transitional period (the CTACSub authorisation was submitted before the latest application date), and will be allowed to continue using Chromium(VI);
- the obligations linked to the CTACSub authorisation (monitoring conditions, etc.) will no longer apply. However, it is still strongly recommended to continue monitoring activities as done so far, in order to maintain and demonstrate protection of workers, local communities, and the surrounding environment.
This transitional period will remain in effect until the Commission is able to make a decision.
