On 11 June 2020, Regulation 2020/1182 was published, which constitutes the XV ATP (Adaptation to Technical Progress) of the CLP Regulation. The purpose of the Regulation is primarily to amend or introduce new entries in Annex VI of the CLP.

XV ATP CLP: WHAT’S NEW AND WHICH SUBSTANCES ARE INVOLVED

The XV ATP introduces new harmonised classifications, modifies existing ones, and defines scenarios for future changes. Among the most relevant updates are the following:

  • Lead (CAS 74-39-92-1, substance numbers 082-013-00-1 (lead powder; [particle diameter < 1 mm]) and 082-014-00-7 (massive lead; [particle diameter ≥ 1 mm])): the environmental classification for massive metallic lead (Acute 1 H400 M= 1, Aquatic Chronic 1 H410 M=10) was not added. Originally, the committee had proposed applying the same environmental classification to both the massive and powdered forms. However, many elements and data still need to be considered, therefore the committee reserves the right to proceed with further evaluation on the matter.
  • “2-butoxyethanol; ethylene glycol monobutyl ether” (CAS 111-76-2): despite the availability of new scientific data related to the hazard class “acute toxicity (inhalation)”, which suggest that the current classification for this class may not be adequate, the acute oral toxicity classification remains unchanged.

WHEN IT APPLIES

The new harmonised classifications will apply from 1 March 2022, however, early voluntary compliance before the deadline is possible.

It is advisable to check whether the substances listed in the XV ATP are present in your products, in order to determine whether it is necessary to update the Safety Data Sheets and product labels.
