The Regulation (EU) 2017/542 introduced some new developments regarding hazardous mixtures: TEAM mastery is ready to support companies in overcoming this new challenge.

On 1 January 2020, Regulation (EU) 2017/542 will enter into force, constituting the Annex VIII of the CLP Regulation (EC No. 1272/2008): the main goal is to harmonize the notification systems for hazardous mixtures, which currently vary across each EU Member State.

MAIN UPDATES IN THE CLP FRAMEWORK AND HAZARDOUS MIXTURES

The main updates introduced by the Regulation are as follows:

  • PCN format – the notification of mixtures will be done using a single format, called the Poison Center Notification Format (PCN Format);
  • PCN portal – in addition to traditional channels, notifications may be submitted through a centralized portal managed by ECHA, which will be responsible for forwarding the information to the relevant Member States;
  • Unique Formula Identifier (UFI) – a unique code to be printed on the label of mixtures; its purpose is to link the specific mixture to the related notified information;
  • product category – each mixture must be assigned a product category selected from those listed in the EuPCS (European Product Categorisation System).

Another change compared to the current system concerns timing: the notification must be submitted before placing the mixture on the market.

SOME KEY DATES…

The Regulation distinguishes between consumer, professional, and industrial use mixtures. Depending on the type of mixture, there are three main deadlines by which the notifications must be made:

  • 1 January 2020, consumer use mixtures
  • 1 January 2021, professional use mixtures
  • 1 January 2024, industrial use mixtures

Notifications already submitted through traditional systems do not need to be updated until 2025, except in the case of product changes.

PRACTICAL IMPLICATIONS

This new regulation has practical implications that cannot be overlooked. Among the most important:

  • mapping the mixture portfolio
  • creation of UFI codes
  • label modification
  • assignment of product category
